Heard learned counsel for the petitioner and learned standing counsel for the state respondent.

By means of present writ petition the petitioner has sought to issue a writ in the nature of mandamus directing the respondent no.3/ in-charge officer, Tehsil Divas, Tehsil Shahganj, District Jaunpur to decide the application of petitioner dated 21.7.2015 within stipulated period as fixed by this Hon'ble Court which is pending before him and also to direct the respondent to vacant the land of Gata No.721 Navin Parti and Chak Marg No. 720 from the respondent nos. 4 to 8 situated at village Salempur Tehsil Shahganj, District Jaunpur.

The grievance of the petitioner is that Gata No. 721  and Chak Marg No. 720 of Village Salempur, Tehsil Shahganj, District Jaunpur have been merged by private respondent nos. 5 to 8 in collusion with village Pradhan respondent no.4 and inspite of complaint and representation filed by the petitioner to authority concerned, no action has been taken. The representation is pending for consideration before Sub Divisional Magistrate.

In view of the above, the writ petition is disposed of with the direction to the respondent no.2 to consider and decide the pending representation of the petitioner in accordance with law within a period of three months from the date of receipt of certified copy of this order.
