Learned counsel for the applicant submits that the applicant is prepared to deposit Rs.1,00,000/-and the matter be referred to Conciliation and Mediation Centre. The applicant undertakes to deposit Rs.1,00,000/- by way of demand draft in the court below within three weeks from today. In the event of compliance, the matter shall be referred to Conciliation and Mediation Centre of the District for which the applicant shall deposit Rs. 5,000/- in the Conciliation and Mediation Centre within the same period.
Upon compliance of the directions, the proceedings of complaint case no. 4191/2011, under Section 138 of the Negotiable Instrument Act, P. S. Collectorganj, District Kanpur Nagar and the order dated 3.12.2015 passed in Criminal Revision No.446 of 2015 (Mohammad Ahmad Vs. Mahesh Chandra Gupta and others) shall remain stayed till decision in the conciliation proceeding which shall be concluded preferably within two months.
In the event of default, the application shall stand dismissed without reference to this Court.
