It is contended on behalf of the petitioner that his pay fixation was made in terms of Regulation 10 (4) (a) and (b) of U.P. Co-operative Societies Employees Service Regulations, 1975. Subsequently, a pay fixation order has been passed on 10.05.2012 by the respondent no.2, which is on record as Annexure-3 to the writ petition.
It is stated that the said order has been recalled on the wrong premise. It is further submitted that the same officer, who has passed the impugned order, had implemented the earlier order by order dated 20.05.2013. Thus, the allegation against the petitioner that the order was obtained by fraud in collusion with an employee of the Bank, is incorrect.
Supplementary affidavit filed today is taken on record.
Matter needs consideration.
Learned Standing Counsel appears for respondent no.1, Sri Abhishek Mishra appears for respondent no.2 and Sri Shiv Nath Singh has put in appearance on behalf of respondent no.3.
As prayed by them, six weeks time is granted to file counter affidavit.

It is made clear that if by the next date counter affidavit is not filed, the application for interim order shall be considered on the next date.
