This petition has been filed for quashing the entire criminal proceedings of Criminal Case No. 25432 of 2016 - (State of U.P. Vs. Sandeep Awana) arising out of Case crime No. 1748 of 2015, under Sections 406 & 506 I.P.C, Police Station - Indirapuram, District - Ghaziabad, pending in the Court of Chief Judicial Magistrate, Ghaziabad and further to stay the further proceeding of the above referred case.

It is submitted by learned counsel that the matter is civil in nature and applicant is ready to pay the entire dues and it is requested that matter be sent to the Mediation & Conciliation Centre.

Considering the facts that the matter is civil in nature and the outstanding is being admitted by the applicant.

In the circumstances the matter is referred to the Mediation & Conciliation Centre of the Allahabad High Court. The Mediation Centre will submit its report within a period of three months from today.

The petitioner will submit a bank draft of Rs. 10,000/- before the Mediation Centre and in case respondent appears before the Mediation Centre then Rs. 8,000/- will be handed over to the respondent no. 2 - Adesh Tyagi for expenses of the proceedings before the Mediation Centre and Rs. 2,000/- (two thousand) will be retained for the service rendered.

List immediately after receipt of report of Mediation Centre.
