Heard learned counsel for the parties.

By order dated 29.10.2015 of this Court, abatement application moved on behalf of respondent was allowed and appeal was dismissed as abated. Then restoration application no. 54445 of 2016 alongwith delay condonation application no. 54443 of 2016 has been filed by appellant side, the copy of which has not been furnished to the counsel for the respondent till now. The applicant/appellant is directed to furnish copy of the aforesaid applications to the learned counsel for the respondents.

List this case on 12th August, 2016.

It is made clear that original second appeal has been dismissed by order dated 29.10.2015  of this Court and no interim/stay order is existing in this matter, so appellant cannot take advantage of pendency of said time barred restoration application  in any proceedings.
