Issue notice to respondents no.1 and 2 fixing 1.10.2015 as the date. Steps be taken by speed post.

All the respondents may file counter affidavit by the next date of listing.

On behalf of the petitioners, it is stated that after the offer of respondent no.2 was rejected by the Indian Oil Corporation, he preferred Writ Petition No. 12977 of 2015, Jitendra Kumar Paswan Vs. Indian Oil Corporation Ltd. and 2 others. The court has dismissed by means of the order dated 10.3.2015. The judgment has become final for the parties.

The respondent no.2 has thereafter approached the Scheduled Caste and Scheduled Tribe Commission raising a grievance in the matter of rejection of his offer, against, the officer of the Indian Oil Corporation. Despite information about the order the Writ Court, being supplied to the Commission, it has decided to summon the officer of the Indian Oil Corporation.

This, according to the petitioners amounts to sitting in appeal over the judgment of the High Court by the  Commission, which is legally not permissible.

Matter does require inquiry by the Court.

List on 1.10.2015. Till the next date of listing further proceedings before the Schedule Caste and Schedule Tribe Commission shall remain stayed.
