Heard Sri Martunjay Khare, learned counsel for the applicant, and Sri Nikhil Chaturvedi, learned AGA appearing for the State and perused the record.

The first bail application of the applicant was rejected by this Court on merits on 30.03.2015. This is the second bail application filed on behalf of the applicant.

The new ground which has been argued by the learned counsel for the applicant is that all the witnesses of fact including the complainant of the case have turned hostile. The applicant is languishing in jail since 28.01.2015.

Learned AGA has opposed the prayer for bail and submitted that the trial is in progress.

Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Sonu, involved in S. T. No. 27 of 2015, arising out of Case Crime No. 17 of 2015, punishable under Section 376 IPC and 5/6 POSCO Act (Protection of Child From Sexual Offence Act), Police Station Birno, District Ghazipur.

Accordingly, the bail application is rejected.

However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of four months from the date of production of a certified copy of this order, if, there is no legal impediment.
