This application under Section 482 Cr.P.C. has been filed for quashing the charge sheet dated 12.12.2014 as well as  entire proceedings of S.T.No. 508 of 2014 (State of U.P. vs. Anuj and others), under Sections 363, 366, 376 IPC and 4 PASCO Act, Police Station Patehrawa, District Kushinagar.

The contention of learned counsel for the applicant is that the girl in her statement under Section 164 Cr.P.C. has stated that she is a major and has willfully married. The medical report also supports that the girl is major.

The matter requires consideration.

Issue notice to opposite party no. 2 returnable at an early date.

Four weeks time is granted to opposite party no. 2  to file counter affidavit. Rejoinder affidavit may be filed within three weeks thereafter.

List thereafter before appropriate Court.

Till the next date of listing, further proceedings of S.T.No. 508 of 2014 (State of U.P. vs. Anuj and others), under Sections 363, 366, 376 IPC and 4 PASCO Act, Police Station Patehrawa, District Kushinagar shall remain stayed.
