The petitioner has challenged the impugned orders dated 29.8.2014 and 20.3.2014 by which a recovery has been ordered against him by way of punishment.

The petitioner contends that the amount in question has already been deposited by him yet action for his removal from service is being threatened, if he does not deposit the said amount vide letter dated 29.8.2014.

The counsel for the petitioner has invited the attention of the court to the receipt dated 03.04.2014 contained as Annexure-9 to the writ petition as a proof of the deposit.

Let the respondents file counter affidavit within four weeks. In the meantime, the respondents are directed to have a re-look into the matter and if the petitioner has already deposited the amount in question on 03.04.2014 then further proceeding for removal from service in terms of order dated 29.8.2014 shall not be taken.

The petitioners submits that he has already submitted a reply to the letter dated 29.8.2014.

The respondents shall proceed only after considering the reply submitted by the petitioner on 09.09.2014.

List after four weeks.
