Hon'ble Rajes Kumar,J.

Hon'ble Om Prakash-VII,J.

Both the parties appeared in person. We have interacted with both the parties. Smt. Suman Sharma, the wife states that two daughters, one born on 11.5.2000, is now  aged 14 years and the other,  born on 8.3.2003, is now aged 11 years. Both the daughters are with her. She stated that she is willing to live with the appellant at any cost and is ready to tender apology for anything wrong,  if any, committed by her. She stated that it is not possible at this stage to maintain the two grown up daughters. The husband, at present, is  showing a little bit reluctance.

We are of the view that it would be appropriate to allow some more time to the appellant to settle the dispute and to create an atmosphere of reconciliation. The respondent states that the  appellant is the Manager in a Hotel and is getting salary about Rs.40,000/- per month. She is a practicing lawyer at Allahabad. There is no evidence on record about the income of the husband.

We are of the view that the interest and welfare of the daughters should be protected.  Accordingly, we  direct the appellant to prepare a fixed deposit of Rs.7,500/- each in the name of two daughters every month. This amount shall be utilized at the time of the marriage of their daughters and shall pay Rs.2500/- by way of bank draft every month for maintenance and education of each.  In case if the appellant fails to pay the aforesaid amount, it will be open to the respondent to move an application before this Court for further orders. Amount which the appellant is paying shall be adjusted with the amount as directed above.

List on 8.12.2014. On that day, both the parties shall appear in person.

Order Date :- 24.9.2014
