This writ petition is moved by four petitioners. They claim that they are candidates for appointment of class IV post in a recognized institution namely  Rashtriya Inter College, Chiraiyakot, district Mau, which is an aided institution.

The grievance of the petitioners are that the Principal of the abovenamed Institution has advertised for recruitment of class IV post and after selection, papers  were sent for approval to the District Inspector of Schools, Mau. However, no action has been taken at his end.

The counsel for the petitioners submits that the petitioners have been unofficially informed that the State Government has imposed a ban on appointment of Class III and IV employees in the government offices and this is also applicable to the educational institutions. He submits that this Court in the case of C/M Lala Babu Baijal Memorial Inter College, Lodipur, Ghaziabad and another Vs. State of UP and others reported in 2012(4) ADJ 586 has held that the Government Order dated 6.1.2011 is not applicable to the educational Institutions.

Having regard to the facts and circumstances of the case, in my view the ends of justice requires that the District Inspector of Schools, Mau (Respondent no. 2)  be directed to consider for approval of the name of the petitioners for appointment of Class IV employees in the institution.

The petitioners are permitted to file a fresh representation alongwith certified copy of this order before Respondent no. 2 within two weeks from today. In the event such representation is filed by the petitioners, the same shall be considered by Respondent no. 2 expeditiously.

With the aforesaid directions, the writ petition is disposed of.
