Heard Shri Lalla Ji Maurya, learned counsel for the petitioner.

By order dated 16.3.2014 and 16.9.2014 counsel for the respondents was directed to seek instructions in the matter with regard to payment of arrears of family pension to the petitioner.

Shri Rahul Shukla, learned counsel for the respondents prays for further time to seek instructions.   However, from Annexure-4 to the writ petition it is noticed that a sum of Rs. 1,004/- towards family pension has already been sanctioned to the petitioner w.e.f. 23.3.2013 and the petitioner has also obtained a succession certificate for a sum of Rs. 1,20,864/-.  

Smt. Raj Rani, the second wife of late Parshu Ram has already expired, therefore, the respondents should explain as to what is the hindrance in making the future payment of family pension to the petitioner.   So far as the family pension as claimed by the petitioner, the said amount has already been paid to Smt. Raj Rani and the petitioner has to claim the same from the heirs of Smt. Raj Rani.
