An affidavit has been filed on behalf of the S.S.P, Bareilly by Sri Amar Singh, Circle Officer, Bahedi, Bareilly along with the exemption application that the S.S.P., Barielly could not appear before this Court due to Maharshi Balmiki Jayanti and some Shobha Yatra is said to be taken out.

The said exemption application on behalf of S.S.P, Bareilly is allowed and his presence is dispensed with.

Dr. Vijay Kumar Yadav, C.M.O., Bareilly is present before this Court in compliance of this Court's order dated 06.09.2014 and he states that he has written a letter to the Director, Forensic Science Laboratory for making available the viscera report of the deceased.

Leaned AGA states that the CJM has also passed an order for calling the viscera report on 22.09.2014 for transmitting the viscera report of the deceased but till date viscera report is awaited.

Learned AGA states that he has not received the aforesaid viscera report in spite of the communication to the S.S.P. Bareilly and the viscera report is still awaited.

The Superintendent of Police, Bareilly as well as Director, Vidhi Vigyan Prayogshala, Bareilly shall appears in persons before this Court along with D.N.A. report and Director, Vidhi Vigyan Prayogshala, Bareilly shall file an affidavit stating the total number of samples which have been received by the lab regarding viscera and D.N.A. test for last two years i.e. 01.01.2012 till date and in how many cases the reports have been sent to respective courts and also the details of the said report which are still pending.

The Registrar General is directed to send the certified copy of this order to the Director, Forensic Science Laboratory, Bareilly as well as learned AGA for its compliance.

List on 28th October, 2014.

The appearance of Dr. Vijay Kumar Yadav, C.M.O., Bareilly is dispensed with.
