The petitioner is physically handicapped person who is said to be undergoing dialysis. It is alleged that his salary has not been paid since November, 2013, thereby causing grave hardship.

Learned counsel for the petitioner has invited attention of the Court to a letter of the Chief Engineer, Rural Engineering Service (East) U.P., Lucknow dated 5.9.2014,  addressed to the Executive Engineer, Rural Engineering Service, Prakhand Jaunpur for taking requisite action as per Rules.

Put up this case on 19.11.2014,  to enable learned Standing Counsel to seek instruction from the respondent no. 3 as to under what circumstances salary of the petitioner is not being released in his favour.

It is made clear that if there is no impediment and such salary is legally admissible to the petitioner for the period  in question, the same shall be released and pendency of the writ petition shall not be an impediment in this regard.
