The petitioner is a Shiksha Mitra, who was engaged on contract basis  on 27.3.2006. In 2007 upon some ailment she absented from duty  but in 2011 she presented an application for joining the post.

The Village Education Committee passed a resolution in her favour  and the District Basic Education Officer by order dated 6.9.2011  allowed her to join. She was continued  as such but by the impugned order dated 27.1.2014 her appointment has been cancelled on the ground that she absented from 3.10.2007 to 26.9.2011 unauthorizedly  and could not have been allowed to join the post.

It is not disputed  that she joined the post  after the recommendation  of the Village Education Committee  and upon the approval of the District Basic Education Officer but by the impugned order  dated 27.1.2014 the District Basic Education Officer has cancelled the approval earlier granted to the petitioner. 

The matter requires consideration.

Learned Standing Counsel represents respondent nos. 1 and 2. Sri Santosh Kumar, learned counsel has put in appearance on behalf of respondents no.3 and 4. Sri Amresh Singh, learned counsel has put in appearance on behalf of respondent no.5.

The respondents may file counter affidavit within one month.

List thereafter.

Till the next date of listing,  the operation of the impugned order dated 27.1.2014 shall remain stayed.
