Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant has submitted that the applicant has been falsely implicated in the case and he is in jail since 19.12.2013. It has also been submitted that the applicant has no previous criminal history. It has also been submitted that the similarly placed co-accused Shafiq, Sanjeev Kumar Pathak, and Amit Kumar Agnihotri have already been granted bail by another Bench of this Court vide orders dated 06.02.2014, 13.02.2014 and 18.02.2014 passed in Bail No. 671 of 2004, 873 of 2014 and 969 of 2014.
Learned AGA has opposed the prayer of bail.
Taking into consideration the facts and circumstances of the case, but without expressing any opinion on merits, let the applicant Ejad urf Pale be released on bail in Case Crime No.640 of 2013 Under Section 3/5/8 of Prevention of Cow Slaughter Act, P.S. Pali, District Hardoi on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:-
(i)The applicant will not tamper with the evidence during the trial.
(ii) The applicant will not pressurise/ intimidate the prosecution witness.
(iii)The applicant will appear before the trial court on the date fixed.
In case of breach of any of the above conditions, the court below shall be at liberty to cancel the bail.
