Heard learned counsel for the appellant and learned A.G.A. for the State of U.P.

This appeal has been filed under section 374 (2) Cr.P.C. against the judgment and order dated 10.4.2014 passed by Additional Sessions Judge, Court No.1, Hardoi, whereby the appellant has been convicted for offence punishable under Sections 498-A I.P.C. and sentenced to R.I. for two years and fine of Rs. 2,000/-, in default, he has been further awarded two months imprisonment. He he has also been convicted for the offence punishable under Section 304- B I.P.C. and sentenced to R.I. for ten years and for offence punishable under Section 4 D.P. Act and sentenced to R.I. for one year and fine of Rs. 5000/-, in default, he has been further awarded additional four months imprisonment.

Learned counsel for the appellant submits that the trial court has committed manifest errors of law and facts  and also submitted that co-accused Phool Singh and Smt. Kindari have filed another appeal no. 495 of 2014 under Sections 498A, 304-B I.P.C. and Section 3/4 D.P. Act.

Learned A.G.A. has opposed the above submissions.

Considering the rival submissions made by learned counsel for the parties and facts and circumstances of the case, I am of the view that the matter requires re-consideration by this Court.

List on 4th July, 2014. Record of Lower court, if not received, in the above criminal appeal, be summoned through District Judge, Hardoi within a period of two weeks from today through Special Messenger.
