This petition filed under Section 482 of the code of Criminal Procedure seeks quashing of summoning order dated 31.1.2011 as well as N.B.W. order dated 4.6.2014 under Sections 147/323/504/506/427/452 I.P.C., Police Station Kunda, District Pratapgarh, passed by Additional Chief Judicial Magistrate, Kunda, Pratapgarh, in Complaint Case No.1733/2010, Ram Das v. Shri Kishan and others.

This court finds that the petitioners were required to appear before the lower court sometime after January 2011. No plausible reason has been shown for non-appearance before the lower court. The fact that Non-bailable Warrant has been issued indicates default on the part of the petitioners resulting in causing considerable delay in proceedings before the trial court.

Let ordersheet of the lower court after 31.1.2011 be filed.

List after three weeks.

Order Date :- 11.7.2014
