Heard learned counsel for the parties and perused the record.

This application u/s 482 Cr.P.C. has been filed with the prayer to quash the entire criminal of complaint case no. 1702 of 2012, Mahendra Vs. Firtoo and others under Sections 323, 504, 506, 427, 379 I.P.C. P.S. Sarai Khawaja, District Jaunpur, pending in the court of A.C.J.M. IVth Jaunpur and summoning order dated 19.11.2013.

Learned counsel for the applicant contended that allotment with regard only 0.03 dismal and total of area was 0.032 hectare. Hence under the settlement the chack road was carried out from the gram sabha land. However on the basis of false allegation and concocted story the impugned complaint has been filed.

Issue notice to opposite party no. 2,returnable at an early date.

List after six weeks .

Till the next date of listing, further proceedings in Complaint Case No. 1702 of 2012, Mahendra Vs. Firtoo and others under Sections 323, 504, 506, 427, 379 I.P.C. P.S. Sarai Khawaja, District Jaunpur, pending in the court of A.C.J.M. IVth Jaunpur shall remain stayed.
