Heard Sri Shashi Nandan, learned Senior Counsel assisted by Sri Rahul Agrawal for the petitioner and Sri S.M. A. Kazmi, learned Senior Counsel assisted by Sri V.K. Rai and Sri S. A. Kazmi for the respondents.
The issue that has been raised in this writ petition centers around the financial soundness of the petitioner company which has been assessed under the evaluation reports to be insufficient in respect of the fact that the technical bid of the petitioner has been found to be correct. The petitioner has been non-suited on the said ground and consequently the price bid given by the petitioner has not been opened.
The Court has entertained this petition and statement was given by learned counsel for the respondents that the contract is not to be finalised. Consequently, noting the said statement, order has been passed.
Sri Kazmi states that the matter is extremely urgent keeping in view the nature of the project.
The arguments have been advanced by Sri Shashi Nandan but could not be concluded today. Hence, the matter shall be taken up for further hearing on Wednesday i.e. 16.07.2014
Interim order, if any, shall continue till next date of listing.
