Sri R.K. Maurya, learned AGA for the State pointed out that the statement of Sri Atul Kumar, Advocate, learned counsel for the applicant appearing in the case of co-accused Najim that co-accused Afsar has already been granted bail by the court below was found to be incorrect. Subsequently, the bail application was moved on behalf of the applicant and came up before Hon'ble A.K. Tripathi, J. on 27.10.2014 and contention of learned counsel appearing on behalf of the applicant in bail application of Nijam was incorrect as applicant was never granted bail and he moved the present bail application. Thereafter, when the said fact was argued before another Bench, it was directed that the matter to be placed before this Court after obtaining nomination from Hon'ble the Chief Justice, which has been nominated to this Bench and listed today in the cause list.
Sri Ram Kumar Verma, Advocate holding brief of Sri Ajay Kumar Chaudhary, learned counsel for the applicant prays for adjournment.

On the next date, Sri Atul Kumar, Advocate, who is appearing on behalf of the co-accused Nijam in the said bail application shall remain prsent. Copy of this order shall be served to Sri Atul Kumar, Advocate by Sri Ram Kumar Verma, who is appearing on behalf of the Sri Ajay Kumar Chaudhary, learned counsel for the applicant.
