Heard learned counsel for the applicant-appellant and learned Additional Government Advocate and perused the record of the case.

This is the second bail application. The first bail application was rejected on 6.12.2012 by Hon. Dharnidhar Jha and Hon. Yogesh Chandra Gupta,JJ. Thereafter second bail application has been filed. Learned counsel for the applicant has simply argued that the appellant is in jail for about 13 years i.e. since 3.7.2001.

Per contra, learned A.G.A has opposed the prayer for bail and submitted that the rape and murder was committed on a 10 years old girl and  the appellant was apprehended at the spot.

Having given our thoughtful consideration to the submissions of the parties,  without expressing any opinion on the merits of the case, we decline to grant bail to the appellant at this stage.

The prayer for bail is refused.

List this case for hearing at very early date if possible in the next cause list.
