1.     Sri Amit Shukla, learned counsel for the petitioner and Sri C.B. Gupta, learned counsel for the respondent has filed a supplementary counter affidavit of Sri Raj Kumar Singh, Manager of the respondent company.

2.     In paragraph no. 4 and 7 of the supplementary counter affidavit, it has been stated that the cheque of Rs.3,00,000/-  was issued in the joint name of M/s R.A. Construction and M/s B.K. Construction (JV)  which was deposited in the Allahabad Bank, Branch Kalyani Devi, Allahabad on 24th August, 2007 and the amount was subsequently returned by the joint venture to the petitioner under Receipt dated 18th February, 2008, a Photostat copy of which has been filed as Annexure No. SCA-3.

3.     Learned counsel for the petitioner prays for and is granted a week's time to file supplementary rejoinder affidavit. On the next date of listing the respondent shall also produce the original alleged receipt dated 18th February, 2008.

4.     As jointly prayed, list in the next cause list.
