Heard learned counsel for the petitioner and learned Standing Counsel.
The post of District Youth Welfare and PVD Officer fell vacant as a result of transfer of one Km. Subhashini in the month of June, 2013, consequently petitioner was given officiating charge initially by order dated 10th June, 2013 and thereafter by order dated 5.12.2013.
Learned counsel for the petitioner states that appointment on the post of District Youth Welfare and PVD Officer as per rules is made from two sources i.e. 50%, direct recruitment and 50% from amongst the Regional Youth Welfare and PVD Officers. It is further stated that large number of District Level posts are being manned by the similarly situated persons due to shortage of regular strength of District Level Officers. For making officiating arrangement State Government has not adhered to any seniority of the officers at the regional or State level.
In the circumstances stated above, we hereby provide that the petitioner shall be allowed to work till a person senior to him or a new regular officer of the divisional rank is posted to officiate or work on the said post and in the meanwhile impugned order shall remain in abeyance.
Counter affidavit may be filed by the Learned Standing Counsel within four weeks.
