Shri Patanjali Misra, Advocate has made a statement that so far as the appellant no.1 Brijendra Swaroop alias Chunni Lal is concerned, he has since expired. With regard to appellants no. 2 and 3 he has no further instructions.

The appeal is of the year 1994. Hearing of the appeal cannot be proceeded with for want of assistance.

In such circumstances, we have no other option but to cancel the bail granted in favour of the appellants Brijendra Swaroop alias Chunni Lal, Sri Krishna and Chunoo Yadav alias Baijnath Yadav under the order of the Court dated 11.8.1994. It is ordered accordingly.

Let the Chief Judicial Magistrate, Hameerpur ensure that all the aforesaid appellants are arrested and are produced before this Court on the next date.

Copy of this order be forwarded to the Chief Judicial Magistrate, Hameerpur by 25.8.2014.

List on 11.9.2014.

The Chief Judicial Magistrate, Hameerpur shall submit his compliance report before the court by the next date.
