Sri Manoj Goswami, learned Standing Counsel submits that in pursuance to the order of this Court dated 4.8.2014 the Rent Control and Eviction Officer/Sub-Divisional Magistrate, Sadar, Hari Lal is present in the Court and that he has received instructions from the District Magistrate and would be filing his counter affidavit as well as the report of the District Magistrate as directed within a period of ten days.

As prayed, two weeks time is allowed to the learned Standing Counsel to complete the formalities.

Sri Rahul Sripat may file rejoinder affidavit within a week thereafter.

The presence of Hari Lal, Rent Control and Eviction Officer/Sub-Divisional Magistrate, Sadar is dispensed with.

Sri Murli Dhar Misra, learned counsel appearing for respondent No.2 has filed supplementary affidavit. It may be taken on record.
