Learned counsel for the appellant submitted that there is a specific clause in the agreement for non-payment of interest and, therefore, interest at Rs.3,43,521/- in the award is not justified.
The matter requires consideration.
The entire amount of award shall be deposited with the District Judge, Gorakhpur within four weeks. Out of the amount deposited, the claimant shall be entitled to withdraw a sum of Rs.11,25,888/- and the balance amount of Rs.3,43,521/- towards interest shall be kept in a fixed deposit scheme in a nationalized bank, yielding maximum interest and the payment of the same shall be subject to the decision of the appeal.
