Argument is that petitioner has decided the chak matter on 8.8.1972 aganst which according to his information/knowledge no appeal etc. was filed and thereafter petitioner stood retired on 31.1.1992.

Submission is that on 30.1.1992 a charge sheet was given and after about ten years report was submitted and after getting reply now the impugned order has been passed by which amount of 30% towards pensionary benefits has been directed to be deducted.

In view of the aforesaid, matter needs disposal after getting response from the respondents.

Notices meant for respondents 1 to 3 have been accepted by learned Chief Standing Counsel.

Sri V.P. Mathur, learned Advocate appeared on behalf of respondent no. 4.

Counter affidavit may be filed on or before the next date.

List this matter after six weeks.

As an interim measure, we direct that the till the next date of listing no amount will be deducted from the pensionary benefit of the petitioner.
