Smt. Sweta Agrawal appears in person. Learned counsel for the appellant submitted that Sri Amitabh Kumar Goyal could not come to the Court due to unavoidable circumstances. Smt. Sweta Agrawal submitted that she has already filed affidavit stating therein that Criminal Misc. Application No. 3676 of 2009 under Section 482 Cr.P.C. filed in this Court for quashing of the chargesheet, she would have no objection for quashing of the chargesheet, in case if the appellant withdraws appeal filed against the order of the Family Court dated 7.4.2000 whereby the Family Court has allowed the suit under Section 13 of the Hindu Marriage Act filed by her.

Learned counsel for the appellant submitted that he has received instruction from the appellant not press the appeal in case if the respondent is ready to withdraw all the criminal cases and may not contest the case before this Court.

In the circumstances, we direct the learned counsel for the appellant to file an affidavit of Sri Amitabh Kumar Goyal on the next date.
