Argument is that so far the post of Regional Secretary Madhyamik Shiksha Parishad, Varnasi is concerned there is only one post on which petitioner was posted and there is no order for shifting the petitioner although he is to retire within 2 months i.e. on 30.9.2014.

Submission is that on this fact petitioner is entitled to get protection of this court.

As an interim measure this court directs that in the event  there is no order of shifting of the petitioner, as on date,  then operation of the order dated 15th July, 2014 shall remain stayed.

Notices meant for respondents 1 and 2 has been accepted by learned Chief Standing Counsel. Issue notice to respondent no. 3. Steps will be taken within ten days.

List this petition immediately after service.
