Pursuant to the order of this Court dated 26.2.2014 opposite party nos. 1 and 2 are not present  and opposite party no. 3 is present.

An affidavit on behalf of Mahendra Kumar Nigam, Executive Engineer Barrage Construction Division II Phoolbagh, Kanpur has been filed stating therein that the opposite party no. 1 is on official Government tour from 7.7.2014 to 11.4.2014 in foreign countries of Span and Portugal that is why he can not appear before the Court.  So far as presence of opposite party no. 3 is concerned an affidavit has been filed duly sworn in by him stating therein that the order has already been passed in Misc. Application Case No. 34 of 2012 on 4.4.2014. 

Learned counsel for the applicant wants time to verify the facts of the affidavit filed today.

List on 5th May, 2014.  On that date opposite party nos. 1 and 2 shall remain present before the Court. Opposite party no. 3 need not to appear before the Court on that date.  In case the order is complied with in its letters and spirit opposite party nos. 1 and 2 also need not to appear in person before the Court.
