The petitioner has been promoted in the year 1993 on ad hoc basis. By the impugned order, the petitioner has been reverted back to his original position on the ground that on consideration of the case of the petitioner for regularization of promotion he was not found suitable.

Learned counsel for the petitioner submitted that during the period of service for more than 22 years, neither any disciplinary action has been taken nor the petitioner has been subjected to any penalty or any charges. No reason has been communicated that why the petitioner has not been found suitable for regularization of promotion inasmuch as no opportunity has been given.

Let the learned Standing Counsel produce the report/minutes of the Committee wherein the petitioner is found to be non-suitable for regularization of promotion.

Put up on Tuesday i.e. on 24.9.2013 as fresh.
