        Pursuant to the Order dated 5th September, 2013, the case has been put up today as a fresh case.

        Learned Standing Counsel appearing for the respondents,  states that  the instructions, as mentioned in the Order dated 12th August, 2013, have been received by him, and as per the instructions, the Divisional Commissioner concerned by the Order dated 12th August, 2013 passed in the Appeal filed by the petitioner has, inter-alia, prohibited fresh allotment of the Fair Price Shop in question.

       In view of the statement made by the learned Standing counsel appearing for the respondents, on the basis of the instructions received by him, Sri Ratan Singh, learned counsel for the petitioner states that the present Writ Petition has become infructuous, and the same may be dismissed as such.

       In view of the statement made by Sri Ratan Singh, learned counsel for  the petitioner, the Writ Petition is dismissed as having become infructuous.

        Interim order, if any, stands vacated.
