Compliance affidavit has been filed by Sri Virendra Singh, District Panchayat Raj Adhikari, Sonebhadra wherein he has stated that so far as first part of the direction given by this Court is concerned, the same has been complied with. So far as the second part of the direction given by this Court, namely, the Principal Secretary, Panchayat Raj is directed to see that the period of engagement of Gram Rozgar Sewak, provided under the Government Order may not exceed for more than three years. In case if any of the Gram Pradhan has allowed any of the Gram Rojgar Sewak to work for more than three years the necessary action be taken against them and amount paid after the expiry of three years be recovered from the concerned Gram Pradhan. It is stated that MANREGA Scheme comes under the Principal Secretary, Rural Development and not under the Principal Secretary, Panchayat Raj.

In view of the above, Principal Secretary, Rural Development is directed to comply with the aforesaid direction and file necessary affidavit in this regard within another period of four weeks. Learned Standing Counsel is directed to communicate this order to the Principal Secretary, Rural Development.
