Memo of appearance has been filed on behalf of opposite party no.2, which is taken on record.

Heard learned counsel for the applicant, learned counsel for the opposite party no.2 and the learned AGA as well as gone through the record.

In pursuance of the order dated 7.8.2013, the applicant(husband) and the opposite party no.2(wife) are present before this Court, who have been identified by their respective counsels.

Upon querry made by this Court, the applicant has stated that there is no chance of mediation or concilliation with his wife, the opposite party no.2.

The wife of the applicant has made several complainants in respect of the conduct of the applicant and under compelling circumstances she is residing with her husband.

In an attempt to settle the matrimonial bickering between the parties, this Court is directing both the husband and wife to settle their differences and withdraw their cases on the basis of a mutual settlement within a period of two months. In case the parties settle their disputes amicably, they shall file a joint agreement before the court of Chief Judicial Magistrate concern by 31st of October, 2013.

List this case before this Court on 11th November, 2013.

Till 31st October, 2013, further proceedings against the applicant shall be kept in abeyance. On the next date of listing, the applicant is directed to handover a sum of ten thousand rupees in the form of bank draft to the opposite party no.2, towards the expenses incurred in litigation. In case of failure to comply the order on the date fixed coercive action shall be taken against the applicant, vacating the interim order.
