This petition has been filed for initiating contempt proceedings against Sri Anil Sant, presently posted as the Principal Secretary, Basic Education, Civil Secretariat, U.P., Lucknow, with the plea that the order dated 07.12.2009 has not been complied with.

Learned counsel for the respondent-applicant Anil Sant contends that the respondent had been transferred and, therefore, assistance was not given. The petitioner did not implead the successor officer.

It has been pointed out that the issue had already been decided by the concerned authority under the signatures of the Secretary, vide order dated 29.3.2012.

Learned counsel appearing for the respondent very fairly concedes that the delay has been caused in informing to the court, however, the same is not intentional. Affidavit of Sri Anil Sant has been filed in which unconditional and unqualified apology has been furnished.

Considering the fact that in deference to the order of this court compliance had been made on 29.3.2012. Order dated 08.5.2013 is hereby kept in abeyance.

List on 08.7.2013 instead of 29.5.2013.

The concerned Chief Judicial Magistrate be informed through Registrar of this Court that non-bailable warrants issued in this case are not required to be executed.
