Heard learned counsel for the applicant, learned A.G.A. and Sri Nishant Srivastava, learned counsel for O.P. No. 3.
This application has been filed with a prayer to quash the charge sheet No. 278 of 2002 in case crime No. C-568 of 2001 under sections 419, 420, 467, 468 IPC, P.S. Kotwali Nagar, District Gonda.
Considering the submission, made by learned counsel for the applicant that in the present case without doing the fair investigation, the charge sheet has been submitted whereas no offence of forgery or cheating has been committed by the applicant and the learned Magistrate has also taken the cognizance on the charge sheet submitted by the I.O. Without applying the judicial mind.
It is directed that in case the applicant moves the discharge application through their counsel within 60 days from today before the court concerned, the same shall be heard and disposed of in accordance with law.
Till the disposal of that application no coercive steps shall be taken against the applicant.
The interim order dated 26.4.2005 is hereby vacated.
Accordingly this application is disposed of.
