Heard Sri Satyendra Kumar Singh, learned counsel for the appellant and Sri Sunil Singh counsel for the informant and learned AGA for State.
The appellant Dhirendra @ Jhingar is stated to be in jail since 14.6.2005. As an under trial also he was not allowed bail. Calculating from the aforesaid date, appellant had served near about eight years of imprisonment. From the date of conviction (6.1.2007), he has served six years of imprisonment.
In view of the aforesaid fact which has not been disputed by the counsel for the informant as well as by the learned AGA, we consider it appropriate to keep the bail prayer of appellant Dhirendra @ Jhingar alive but at the same time hearing of the appeal is expedited.
Office is directed to prepare paper book and list this appeal for final hearing before the appropriate Bench in the second week of July, 2013.
In case the appeal is not heard within a year, the appellant may revive his bail prayer after one year.
