When confronted with the observation that contempt application is frivolous and by no stretch of imagination any case for contempt, as alleged, can be said to be made out, learned counsel for the applicant finding it difficult to assail the same, sought permission of the Court to withdraw the application.

In the facts and circumstances, prayer made is allowed.

Contempt application is permitted to be withdrawn and accordingly stands dismissed.
