Heard learned counsel for the appellant and learned A.G.A. For the State.

Learned counsel for the appellant submits that the appellant has been convicted and sentenced for three years rigorous imprisonment under section 3(1) of U.P. Gangster and Anti Social Activities Prevention Act and a fine of Rs.5000/- and in its default further imprisonment of five months as well as one year's rigorous imprisonment under Section 3/25 Arms Act and with a fine of Rs. 1000/- and in its default further imprisonment of one month.

Learned counsel for the appellant argued that the appellant was on bail during pendency of trial and he did not misuse the terms of the bail.

Let appellant-Santosh Mourya be released on bail in Gangster Case No.227 of 2008, Case Crime No.145 of 2001 and Case Crime No.146 of 2001, under Section 3(1) of U.P. Gangster and Anti Social Activities Prevention Act & under Section 3/25 Arms Act, Police Station-Kotwali Nagar, District-Gonda, on his furnishing a personal bond and two reliable sureties each in the like amount to the satisfaction of the court concerned, provided he shall deposit half of the fine within a month from the date of order and rest half of the fine shall remain stayed during the pendency of appeal.
