HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 29 Case :- WRIT - C No. - 38224 of 2013 Petitioner :- Kunj Bihari Lal Respondent :- State Of U.P. Thru Secy. And Another Counsel for Petitioner :- M.K. Mishra,M.C. Chaturvedi Counsel for Respondent :- C.S.C. Hon'ble Sheo Kumar Singh,J.
Hon'ble Brijesh Kumar Srivastava-II,J.
The prayer made in this petition is for giving a direction to the respondent no. 2 to decide application of the petitioner for executing free hold deed within reasonable time appears to be justified.
If there is no impediment in passing the order for free hold rights and there is any major shortcoming then petitioner is to be informed, otherwise he is to get the result.
Taking of decision certainly is to be expedited as that is in the interest of the revenue also.
In view of the aforesaid, we need not to go into the merits of the matter and to express any opinion but at the same time we propose to dispose of this petition by giving liberty to the petitioner to file certified copy of this order alongwith fresh representation annexing copy of earlier application with a request to expedite passing of the order.
On receipt of the certified copy of this order it will be the concern of the competent authority to pass appropriate speaking orders within shortest possible time preferably within a period of three months from the date of receipt of the move.
It is made clear that this court has not expressed any opinion on merits of the matter and thus the decision of the authority will be his independent exercise.
Writ petition stands disposed of accordingly.
