In an identical matter being Writ-C No. 13436 of 2012 (Devendra Tripathi vs. State of U.P. & Others), the Court has directed registration of criminal case after holding enquiry as the fund released was not utilized for raising construction and was also found to be misappropriated.

In this case also, there is no other material on record to show that the fund was in fact utilized except the utilization certificate.

Learned counsel for the petitioners thus prays for and is permitted a week's time to file photographs of the construction claimed to have been raised upon release of the first instalment.

List the matter thereafter.
