This petition seeks initiation of proceedings under the Contempt of Courts' Act 1971 against the respondent for willful disobedience of order dated 13.2.2.13 rendered in Writ Petition No.1161 (MB) of 2013.
Learned counsel for the petitioner contends that after passing of the above noted order, the petitioner sought details of the payment required to be made by him. Even the details have not been given by the respondent and, therefore, could not make the required payment. So as to frustrate the order of this court, in willful disobedience of the order, the said amount is not reflected. Contempt of Court has been committed.
Issue notice to respondent by way of Ordinary Post, Registered A.D. Post and Speed Post, returnable on 30.8.2013.
List on 30.8.2013.
Let counter affidavit/affidavit of compliance be filed before the next date of listing.
It is made clear that in case the counter affidavit/affidavit of compliance is not filed before the next date of listing, costs amounting to Rs.5000/- (five thousand only) shall be imposed.
It is further made clear that in case the order is not complied with, the respondent shall be required to show cause as to why proceedings under the Contempt of Courts' Act be not initiated against them.
Steps be filed within two days from today.
It is provided that if the steps are not filed within the time provided therefore, this petition shall be deemed to be dismissed, without reference to Court.
