Heard Sri Shailendra Singh, learned counsel for the applicants and learned AGA for the State.
It is contended by the learned counsel for the applicants that the marriage between applicant No.1 and opp. party No.2 was solemnized 26 years ago and differences arose between the husband and wife and the wife had left the house of her husband. He further submits that applicant Nos. 2 to 5 used to help the applicant No.1 and on account of the said fact they have also been arrayed as accused in the present case along with applicant No.1. There is no evidence to show that applicant No.1 has remarried with applicant No.2.
Notice on behalf of opp. party No. 1 has been accepted by the learned AGA.
Issue notice to opp. party No.2 returnable within four weeks at the address given in the petition.
Opp. party No.2 may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks.
List immediately after expiry of the aforesaid period before the appropriate Bench.
Till the next date of listing, further proceedings of complaint case No.3349 of 2012, Guddu Vs. Smt. Aneesha and others, under Sections 494,504,506,406 I.P.C., Police Station Mahrajpur, District Kanpur Nagar, pending in the Court of M.M. 5th, Kanpur Nagar shall remain stayed against the applicants.
