This petition has been filed with the plea that respondent nos.4 to 7 have illegally detained the alleged detenue Ram Lakhan Yadav.
Interestingly, the petition has been filed through one of the sons, namely Ranvijay Yadav. The illegal custody of the alleged detenue is said to be by respondent nos.4 and 5, who are also sons of Ram Lakhan Yadav, the alleged detenue.
It has been stated at the Bar that Ram Lakhan Yadav is ailing and is required to be treated in Bombay. Respondent nos.4 and 5 have illegally detained Ram Lakhan Yadav. The said respondents do not want to get Ram Lakhan treated in Bombay.
So as to show bona fide and that the statement is truthful, the deponent undertakes to make a deposit of Rs.10,000/-(Ten thousand only) by 16.4.2013.
On making the deposit, issue notice to respondent nos.4 to 7 through the Chief Judicial Magistrate, Pratapgarh, and Chief Judicial Magistrate, Jaunpur, as per the addresses of the respondents, returnable on 24.4.2013.
Respondent nos.4 to 7 are directed to produce Ram Lakhan Yadav in court.
It is made clear that in case the deposit is not made by the given date, the petition would be dismissed with costs on the next date of listing.
