Heard Sri D.K Yadav, learned counsel for the applicant and learned A.G.A. for the State.

This 482 Cr.P.C. application has been filed with a prayer to quash the entire proceedings of Case No. 264 of 2011  under Section 504, 506 of    I.P.C., police station Matsaina, District Firozabad pending in the Court of C.J (S.D), Firozabad.

From the perusal of record, it appears that the matter being matrimonial in nature was referred on 9.2.2012 to the Mediation and Conciliation Centre of this Court and the report of the Mediation and Conciliation Centre dated 7.7.2012 is on record, from which it is evident that the mediation between the parties have completed but they have arrived at no agreement, hence the mediation has failed..

Notice on behalf of opposite party no. 1 has been accepted by learned A.G.A.

Issue notice to opposite party no.2 returnable within six weeks at the address given in the application. If the requisites for issuing the notice under Registered Postal Cover with Acknowledgment Due are not filed within ten days, this application shall stand dismissed without further reference to any Bench of this Court. Opposite party no.2 may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks.

List immediately after expiry of the aforesaid period before appropriate Bench.  The interim order if any shall continue till the next date of listing.
