This is an appeal by the owner of Truck, bearing registration no. U.P. 78-B.T.-2677. The liability to pay compensation has been fastened on the appellant on the ground that the appellant failed to file any driving licence of the driver of the vehicle, thus, there was a breach of policy.
Learned counsel for the appellant submitted that in the written statement, it was stated that the vehicle was being driven by one Sri Surendra and he possessed driving licence. However, in the written statement, the driving licence number has not been given and it appears that copy of the driving licence has not been furnished. However, driving licence Form -6 is at page 51 of the memorandum of appeal. The said driving licence reveals that the licence for driving the transport vehicle was from 18.2.2011 to 17.2.2014 while the accident took place on 2.5.2010 and on the said date the driver did not possess the valid driving licence to drive the transport vehicle.
Learned counsel for the appellant prays that the matter may be taken up on Monday (8.4.2013) to look into the matter.
On his request, put up on Monday (8.4.2013) as fresh.
