1. Gist of the issue is that one Irfan Ahmad approached Canara Bank, Civil Lines, Allahabad. For seeking Cash Credit Limit, the property, purportedly owned by Irfan Ahmad, was offered as collateral security.
2. The petitioner is a valuer and claims that there is nothing wrong with the report of valuation dated 20.12.2006. In the report, it has been specifically stated that the reported owner is Smt. Draupadi. Purchaser is Irfan Ahmad. It is the admitted case that the sale-deed was executed in favour of Irfan Ahmad on 23.12.2006. Cash Credit Limit was disbursed on 28.12.2006. In these circumstances, the Bank had collateral, offered by Irfan Ahmad in the form of the house valued by the petitioner.
3. Sri Nath has not been able to show to the court as to under what circumstances the petitioner is criminally culpable, in the facts and circumstances given above.
4. On request of Sri Nath, list on 17.5.2013.
5. It needs to be noticed that the petitioner gave valuation of the property as 26.57 lacs. The sale-deed was executed for sale consideration of 26.18 lacs.
6. List on 17.5.2013.
7. Interim order shall continue till the next date of listing.
