This petition for issuance of a writ in the nature of habeas corpus has been filed with the plea that Smt. Alpana Tiwari, the alleged detenue, is being kept in illegal custody by her father, respondent no.3.

The petition has been filed by Sri Dhirendra Tiwari, husband of the alleged detenue, with the plea that Smt. Alpana Tiwari has attained age of majority. A criminal case has been instituted in which Smt. Alpana Tiwari has given a statement that she is married to the deponent and wants to live with him.

So as to establish bona fide the deponent would make deposit of Rs.10,000/- (Ten thousand only) with the Registrar of this court within three days from today, whereupon notice will be issued to the respondent no.3 through the Cheif Judicial Magistrate, Sitapur, returnable on 10.5.2013.

Statement given by Smt. Alpana Tiwari to the investigating agency shall be produced by the learned Government Advocate on the next date of listing.
