Allegedly, Jyotsana Yadav, is being kept in illegal custody by respondent nos.3 to 5, although she is married to Brijesh Kumar, Assistant Professor, Sociology in B.B. Ambedkar University, Raebareli Road, Lucknow.
Learned counsel has pointed out that it is under the influence of respondent no.5 that Jyotsana Yadav is being kept by private respondents and a case under Domestic Violence Act has also been filed against the deponent. The deponent is paying the maintenance amount, as directed. It has been further stated that Jyotsana Yadav is in love with the deponent, however, is being separated on account of influence of the respondents. It is also stated that the detenue wants to join her matrimonial home, is indicated by a card, Annexure-10, received by the deponent.
Issue notice to respondent nos.3 to 5 through the Chief Judicial Magistrate, Allahabad, returnable on 10.5.2013.
The said respondents are directed to produce Jyotsana Yadav in court on the next date of listing. Brijesh Kumar, deponent, shall also remain present in court on the said date.
State is also directed to ensure compliance of this order.
